  • Terms and Conditions for the Sale of Artwork

    1. Payment Terms: Buyers have the option to pay in full up front or to pay a 25% non-refundable deposit, with the remaining balance to be paid in recurring monthly installments until full payment is received. The artwork will be shipped or handed over only after full payment is completed.
    2. Shipping and Handling: The buyer is responsible for all shipping and handling costs. The artwork will be securely packaged and insured for transit.
    3. Returns and Refunds: Returns are accepted within 14 days of receipt if the artwork is returned in its original condition. The buyer is responsible for return shipping costs. Refunds will be processed within 7 business days of receiving the returned item.
    4. Ownership and Copyright: Upon purchase, the buyer owns the physical artwork, but the artist retains all copyright and reproduction rights. The artwork may not be reproduced without the artist’s written consent.
    5. Damages and Loss: If the artwork is damaged or lost during shipping, the buyer must notify the seller within 48 hours of delivery to file a claim with the shipping carrier.
    6. Authenticity: A certificate of authenticity, signed by the artist, will be provided with the purchase.
    7. Customs and Import Duties: For international sales, the buyer is responsible for any customs duties or import taxes that may apply.
    8. Payment Default: If the buyer fails to make a scheduled installment payment within 30 days of the due date, the seller reserves the right to retain the deposit and any partial payments made, and to cancel the sale. The buyer will be notified of the default and given a final 15-day period to make the overdue payment before the sale is officially canceled.
    9. Condition Report: A condition report will be provided upon request prior to the sale. The buyer is encouraged to review this report.
    10. Force Majeure: The seller is not liable for any failure to perform obligations due to events beyond their control, such as natural disasters, wars, or other unforeseen circumstances.
    11. Dispute Resolution: Any disputes arising from the sale of the artwork will be resolved through mediation or arbitration in the jurisdiction of the seller’s location.
    12. Privacy Policy: The seller will protect the buyer's personal information and will not share it with third parties without the buyer's consent, except as required by law.
